Divorce, known as dissolution of marriage in Florida, follows this procedure if it is uncontested:

  • The spouse petitioning for the divorce files the necessary papers according to the circumstances: either a Petition for Dissolution of Marriage with Dependent or Minor Children, a Petition for Dissolution of Marriage with Property but No Dependent or Minor Children, or a Petition for Dissolution of Marriage with No Dependent Children or Property.
  • The other spouse, known as the respondent, may or may not answer the action
  • If minor children are involved, the petitioner also files a Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) Affidavit, which identifies the children, where they live, and provides information about custody.
  • If child support is a consideration, a Child Support Guidelines Worksheet must also be completed.
  • The petitioner must also file several other documents, including a Family Law Financial Affidavit, Notice of Social Security Number, Notice of Current Address and Marital Settlement Agreement, and depending on the circumstances, the standard Family Law Interrogatories for Original or Enforcement Proceedings, which enlarge the financial information requested in the Family Law Financial Affidavit.
  • Once the paperwork has been filed, the petitioner is required to schedule a divorce hearing for the final judgment.
  • At the divorce hearing, the appropriate version of the Final Judgment of Dissolution of Marriage is filed, depending upon the circumstances of the divorce.
