Stuart, Florida Child Visitation Basics

In Florida, a child visitation schedule is referred to as a "timesharing schedule." Parents are encouraged to create this schedule and customize it to meet the needs of the child.

Various courts throughout Florida may have different timesharing guidelines. The Colter Law serves the family law issues of people living in the counties of Martin, Indian River, St. Lucie, and Okeechobee, which is under the jurisdiction of Florida's Nineteenth Judicial Circuit Court. The Nineteenth Circuit Court has a set of general guidelines for timesharing, which include:

• Parents should be flexible and cooperative.
• In an emergency, one parent should notify the other as soon as possible, and no later than six hours after the emergency has occurred.
• The child and primary parent are required to wait no longer than 30 minutes past the designated pickup time, and if the non-residential parent is later than that, he will forfeit that timesharing opportunity.
• After a timesharing period, the visiting parent needs to promptly return the child to the primary parent, and if the primary parent is not at the designated exchange location, he is required to wait 30 minutes.
• Each parent is required to give the other at least 24 hour notice of cancellation of a timesharing period.
• Parents cannot conceal the whereabouts of a child from the other parent at any time, and both parents must keep the other informed of their current residence and mailing addresses, employment, and home telephone numbers.
• Children must be transported in vehicles with operable seat belts, and when applicable, car seats.
• Transportation to extracurricular activities will be the responsibility of the parent who has residential responsibility at that time.
• A specific timesharing schedule will be agreed upon for weekends, weekdays, holidays, vacations, summer, birthdays, and additional visitation.
